SideQuested.xyz Terms of Service

Welcome to SideQuested.xyz (“SideQuested”, “the Service”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of SideQuested.xyz, including our website, web app, features, profiles, focus sessions, recovery logs, XP systems, leaderboards, and related services.

By accessing or using SideQuested, you agree to these Terms. If you do not agree, do not use the Service.

1. What SideQuested Is

SideQuested is a gamified focus-recovery web app designed to help users notice distractions, return to their current “Main Quest”, start focus or respawn sessions, track recovery activity, earn XP, and view progress through profiles and leaderboards.

SideQuested is not a medical, mental health, therapy, counselling, productivity guarantee, education, employment, or professional advice service. It is a lightweight personal productivity and motivation tool.

2. Who Can Use SideQuested

You may use SideQuested only if you can legally agree to these Terms.

You must be at least 13 years old to use SideQuested. If you are under the age of majority in your country or region, you may use SideQuested only with permission from a parent or legal guardian.

By using the Service, you confirm that:

  • the information you provide is accurate and belongs to you;
  • you are not prohibited from using the Service under applicable law;
  • you will use SideQuested only for lawful purposes;
  • you will not misuse, abuse, interfere with, or attempt to break the Service.

3. Accounts and Sign-In

SideQuested currently supports account sign-in through services such as Google and GitHub.

When you sign in, we may receive basic account information from the sign-in service, such as your name, email address, profile image, and account identifier, depending on what the service makes available and what you allow.

You are responsible for:

  • keeping access to your Google, GitHub, or other sign-in account secure;
  • all activity that happens under your SideQuested account;
  • notifying us at support@elseborne.com if you believe your account has been compromised.

We are not responsible for losses caused by unauthorized access to your account due to your failure to protect your sign-in account or device.

4. Your Profile and App Content

SideQuested may allow you to create or store content such as:

  • username and display name;
  • avatar or profile image;
  • bio or profile text;
  • Main Quest titles and descriptions;
  • quest steps;
  • distraction notes;
  • smallest next actions;
  • recovery logs;
  • focus session history;
  • XP, level, streak, and leaderboard activity.

You retain ownership of the content you create or submit to SideQuested. However, you give us a limited, worldwide, non-exclusive, royalty-free license to host, store, process, display, and use that content only as needed to operate, maintain, secure, improve, and provide the Service.

Do not submit content that you do not have permission to use. Do not submit sensitive information that you would not want stored in a productivity app, including passwords, financial secrets, government ID numbers, private medical details, or confidential work information.

5. Public Profile, XP, and Leaderboard Features

SideQuested may include public or semi-public gamification features, including user profiles, leaderboard entries, usernames, display names, avatars, XP, levels, streaks, recovery counts, badges, or other progress indicators.

Unless a feature clearly says it is private, you should assume that leaderboard-related information may be visible to other users or visitors.

Private app activity, such as detailed distraction notes, private quest steps, and personal recovery logs, should not be shown publicly unless you choose to make such information public or a future feature clearly asks for your permission.

We may moderate, hide, edit, or remove public profile information if it is abusive, misleading, unlawful, spammy, impersonating someone else, or otherwise harmful to the Service or other users.

6. XP, Levels, Streaks, and Virtual Rewards

XP, levels, badges, streaks, leaderboard ranks, recovery counts, focus minutes, and similar features are virtual progress indicators inside SideQuested.

They:

  • have no cash value;
  • are not property;
  • are not transferable;
  • cannot be sold, exchanged, redeemed, or withdrawn;
  • may be adjusted, corrected, reset, removed, or recalculated if needed for bug fixes, abuse prevention, product changes, or fairness.

We may change XP rules, streak rules, leaderboard formulas, or reward logic at any time.

7. Acceptable Use

You agree not to:

  • use SideQuested for unlawful, harmful, abusive, or fraudulent activity;
  • harass, threaten, impersonate, or abuse others;
  • upload or share content that is hateful, violent, sexually exploitative, defamatory, invasive of privacy, or illegal;
  • attempt to gain unauthorized access to accounts, systems, or private data;
  • reverse engineer, scrape, overload, spam, attack, or disrupt the Service;
  • bypass security, rate limits, access controls, or sign-in protections;
  • manipulate XP, leaderboards, streaks, focus sessions, or recovery logs through bots, scripts, fake accounts, or other abusive methods;
  • use the Service to store secrets, credentials, or highly sensitive personal information;
  • use the Service in a way that could damage SideQuested, Elseborne Labs, Niraj Makhare, other users, or third-party services.

We may suspend, restrict, or terminate access if we believe you have violated these Terms or created risk for the Service or other users.

8. Third-Party Services

SideQuested may rely on third-party services for sign-in, hosting, storage, analytics, email, deployment, security, and related functionality. These may include services such as Google, GitHub, hosting platforms, storage platforms, and similar service partners.

Your use of third-party services may also be governed by their own terms and privacy policies. We are not responsible for third-party services, outages, data practices, terms, or actions.

If a third-party service becomes unavailable, changes its policies, or limits our access, some SideQuested features may stop working temporarily or permanently.

9. Payments and Future Paid Features

SideQuested may currently be free or may offer free MVP features. We may introduce paid plans, subscriptions, premium features, donations, supporter tiers, or other monetization in the future.

If paid features are introduced, additional payment terms may apply. We will present relevant pricing, billing, cancellation, and refund details before you purchase.

Unless clearly stated otherwise, free access does not guarantee that any feature will remain free forever.

10. Service Availability and Changes

SideQuested is under active development and may change frequently.

We may add, modify, pause, remove, rename, redesign, or discontinue features at any time. We may also temporarily suspend the Service for maintenance, technical issues, security reasons, or operational needs.

We do not guarantee that SideQuested will always be available, error-free, secure, uninterrupted, or compatible with every device, browser, or third-party service.

11. Feedback and Suggestions

If you send us ideas, feedback, bug reports, feature requests, design suggestions, or other comments, you allow us to use them without restriction or compensation to you.

You agree that we may use your feedback to improve SideQuested or related products under Elseborne Labs.

12. Intellectual Property

SideQuested, SideQuested.xyz, the product concept, branding, interface elements, design style, copy, graphics, logos, icons, code, and related materials are owned by or licensed to Elseborne Labs and/or Niraj Makhare, except for third-party materials and user content.

You may not copy, modify, distribute, sell, rent, sublicense, reverse engineer, or create competing services from any part of SideQuested without written permission, except as allowed by applicable law.

13. Privacy

Your use of SideQuested is also governed by our Privacy Policy, which explains what information we collect, how we use it, how we share it, and what choices you have.

Please read the Privacy Policy carefully before using the Service.

14. Account Suspension and Termination

You may stop using SideQuested at any time.

We may suspend, restrict, or terminate your access to the Service if:

  • you violate these Terms;
  • your use creates security, legal, operational, or reputational risk;
  • we detect abuse, fraud, spam, or manipulation;
  • we are required to do so by law;
  • we discontinue the Service or a material part of it.

After termination, some information may remain in backups, logs, legal records, leaderboard history, or aggregated analytics, where permitted by law and explained in the Privacy Policy.

15. Disclaimers

SideQuested is provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, availability, and security.

We do not guarantee that:

  • you will become more productive;
  • you will maintain streaks;
  • XP or leaderboard data will always be accurate;
  • focus sessions will always sync perfectly;
  • your data will never be lost;
  • the Service will be uninterrupted or error-free.

You are responsible for your own decisions, goals, productivity systems, schedules, and work outcomes.

16. Limitation of Liability

To the maximum extent permitted by law, Elseborne Labs, Niraj Makhare, and anyone involved in creating or operating SideQuested will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, loss of profits, loss of productivity, loss of goodwill, device issues, account issues, or service interruptions.

To the maximum extent permitted by law, our total liability for any claim related to the Service will be limited to the greater of:

  • the amount you paid to use SideQuested in the three months before the claim; or
  • INR 1,000.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

17. Indemnity

You agree to defend, indemnify, and hold harmless Elseborne Labs, Niraj Makhare, and anyone involved in operating SideQuested from claims, damages, losses, liabilities, costs, and expenses arising from:

  • your use or misuse of the Service;
  • your violation of these Terms;
  • your user content;
  • your violation of another person’s rights;
  • your violation of applicable law.

18. Governing Law and Disputes

These Terms are governed by the laws of India, without regard to conflict of law principles.

Subject to applicable law, courts located in Pune, Maharashtra, India will have jurisdiction over disputes related to these Terms or the Service.

Before filing a formal claim, you agree to contact us at support@elseborne.com and try to resolve the issue informally.

19. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last Updated” date above.

If changes are material, we may provide additional notice through the Service or by other reasonable means.

Your continued use of SideQuested after updated Terms become effective means you accept the updated Terms.
